Having Fun and Staying Safe This Halloween - 3 Things to Look Out For

Halloween is a fun time for kids of all ages … and adults as well.  Unfortunately, it is also a time of year when accidents happen at a higher rate.  Our Lake of the Ozarks law firm knows that with a little thought and effort, there are many ways to reduce your risk of something bad happening.  We also believe it is well worth the effort.  Gibbons Law Firm has represented clients in various personal injury cases at the Lake of the Ozarks and knows quite well how devastating an accident can be for everyone involved.  This Halloween, there are sure to be some distracted pedestrians out and about.  Likewise, there are likely to be some distracted drivers, or worse, those who are impaired.  So, it is all the more important for you to be extra vigilant to keep yourself and others safe on one of the most fun nights of the year.  If you want to learn what to look out for and how to stay safe this Halloween, keep reading this blog.

1) Distracted Kiddos

As much as parents look out for their kids, teach them to walk on the sidewalks and look both ways before crossing the street … kids tend to forget all these rules when they are excited.  Candy and costumes are just too much of a distraction, and sometimes, kids will dart across an alleyway or a parking lot, or a road.  So, when driving on Halloween night, watch very carefully for children walking on the roadways or curbs.  Even if they are on the sidewalk, be prepared in case they move suddenly into the roadway.  Enter driveways and cross alleys slowly and carefully and be on the lookout for kids in dark clothing or costumes.

If you are taking your kids out trick or treating, make sure they are carrying flashlights or glow sticks.  It also helps to use reflectors or reflective tape to help them stand out to drivers.  Check your child’s costume to make sure it fits properly and does not create a trip hazard or fire risk. Always opt for non-toxic face paint over masks, when possible, to avoid blocking your child’s vision.  Also, even though you will be with them, it is a great opportunity to teach and remind your kids to never go into someone else’s house unless you know them well and trust them.

2) Distracted Adults

Drivers on Halloween may have their own plans for the evening and may be as focused on those as the kiddos are on trick or treating.  Adults, you too, should make sure your costume does not interfere with your vision or mobility while driving.  Keep your eye on the road AND on the side of the road looking for pedestrians and any other seasonal hazards like deer.  Don’t allow things like your passengers, your cell phone, the radio, or anything else to take your attention away from driving, not even for a few seconds.  It only takes about 4-5 seconds to travel the distance of a football field when driving.  Your diligence can be the key to avoiding a personal injury case at the Lake of the Ozarks this Halloween.

3) Drunk Drivers

It is sad to say, but around 40% of fatal car accidents occurring on Halloween each year involved at least one drunk driver.  It is a popular night for parties and drinking, to be sure.  But that does NOT mean it is ok to drive after drinking.  Having a designated driver is a must if you plan to drink at a Halloween party.  Otherwise, limiting your alcohol intake or just abstaining entirely is the right choice.

Happy Halloween from Gibbons Law Firm!

At Gibbons Law Firm, we hope you find these reminders helpful as you plan for a fun-filled weekend.  It is our hope that you are never involved in a serious accident, but if you find yourself in that position, please do not hesitate to call our Mid-Missouri Law Firm.  No matter what your involvement may be, you need legal advice and representation.  All you have to do is call our office at the number below.  Your first consultation is always free. How to Avoid Distracted Driving – 3 Things to Consider

Distracted driving results in about 3,000 deaths each year in the United States, and sadly, that means 3,000 avoidable deaths.  It only takes about 4.6 seconds to travel the length of a football field at highway speed, and that is the average time it takes to send or read a text. You wouldn’t just close your eyes while driving down the highway and feel safe about it, but effectively that is what you are doing when you take your eyes off the road with any distraction.  As your Lake of the Ozarks lawyer, we know the importance of staying focused when you are behind the wheel.  In this week’s blog, Gibbons Law Firm will talk about some of the most common causes of distracted driving and what you can do to avoid them.  If you are interested in keeping you and your loved ones safer by being aware of distractions while driving, keep reading this blog!

1) What Causes It

Just about anything can be a distraction if we allow it to take our attention away from the road.  But there are some really common ones that cause most distracted driving accidents at the Lake of the Ozarks, and some of them you might not really think about. They include mental distractions, visual distractions, and manual distractions.

Mental distractions are things that take your mind off the road like talking to passengers on the phone, thinking or daydreaming, being angry or upset, focusing on kids or pets in the car, and of course, driving under the influence of alcohol or drugs.

Visual Distractions involve things that take your eyes off the road such as adjusting the radio or cabin temperature, looking at your GPS, reaching for items in the car, looking at yourself in the mirror, sightseeing, or looking at a traffic accident.

Manual distractions are things that take your hands off the wheel such as eating, grooming, reacting to spilling something, smoking, looking in your wallet or purse, and again, using your cell phone or GPS.

2) Consequences

While distracted driving may not always involve something that is technically illegal, there can still be some very serious legal consequences for doing it.  If you injure someone because you are negligent behind the wheel you may face a wide range of penalties including the risk of being sued. Even worse, if it causes a fatal accident you will have to deal with knowing that you have taken someone else’s life and everything that comes with that. On the other hand, if you are the victim of someone else’s distracted driving, it is important for you to know your rights by contacting an experienced personal injury attorney at the Lake of the Ozarks.

3) How to Avoid It

Distracted driving is avoidable.  Just setting some ground rules and developing good habits can help you avoid many of these hazards.  First, plan ahead.  Before you even put your car in gear enter the address in your GPS.  Take care of any texts or phone calls ahead of time and consider using an app that disables your phone from making or receiving calls or texts while you are driving. Once you start down the road, be mindful and stay focused.  Don’t spend your windshield time trying to solve problems or thinking about work or the kids. Avoid getting behind the wheel when you are emotionally upset or angry, and never drive when you are tired.  People that wouldn't think about drinking and driving may drive while tired not realizing it can be as dangerous as driving under the influence.  Overall, the more defensively you drive, the safer it is for you and everyone else on the road with you.  You will be less likely to be distracted, and more able to react if someone else is not paying attention.

Our law firm at the Lake of the Ozarks encourages everyone to stay focused and keep their eyes on the road.  Distracted driving is not worth risking, and with just a firm mindset and good habits, it is completely avoidable.  If you find yourself in an accident due to a distracted driver, Gibbons Law Firm can help guide you through the legal process and present your case.  For a free consultation regarding your personal injury case in mid-Missouri, schedule an appointment with us today!  For more legal news and information follow us on social media using the channels listed below.

3 Common Personal Injury Claims and How Gibbons Law Firm Can Help

Personal Injury Law has to do with situations where someone has suffered harm due to the actions of others.  The harm may be physical, emotional, or mental and is usually the result of negligence, meaning the harm was not intended.  But even if it is an accident, when the person who is harmed is facing medical bills, lost wages, pain, and suffering, they need and deserve compensation from the person or entity that is responsible for the harm.

In the United States, statistics show that accidental injuries and medical errors (medical malpractice) are the third leading cause of death in the nation.  That is an alarming number and means that millions of people are affected by personal injuries each year.  At GibbonsLaw Firm, we advocate for those who have been injured to help them obtain the settlement they are entitled to.  If you would like to learn more about common personal injury cases, how to avoid them and what to do if you are a victim of one, and how a personal injury attorney at the Lake of the Ozarks can help, keep reading this blog!  We are going to talk more specifically about 3 common personal injury claims.

1) Car accident

Technically, this can include accidents involving cars, trucks, motorcycles, pedestrians, or buses, and who is at fault will be a central part of the case.  Sadly, many personal injury cases involving car accidents could have been avoided if the drivers had not been distracted by their phones, their GPS, the radio, eating, or even grooming.  It only takes a fraction of a second to change someone else’s life.  Paying attention is the best prevention.  If you are the victim of a car accident that was not your fault, and an insurance company offers you a quick settlement, it may be well below what you should receive, especially if your injuries are life-changing.  Having an attorney looking out for your best interests can significantly increase your chances of effectively proving who was at fault and being properly compensated by an insurance company.

2) Slip and Fall

When a property owner allows dangerous hazards to exist on their premises and those hazards result in someone getting hurt, the property owner can be considered negligent and be at fault.  It is not assumed that the fall was just clumsiness or not paying attention on the part of the victim.  The fall happened for a reason, maybe it was a slippery surface that should have been cleaned, or a broken handrail, a missing board on a walkway, inadequate lighting, etc.  Unfortunately, slip and fall accidents can be more devastating than some think.  They are actually a common cause of brain injuries and hip fractures as well as other injuries.  It is very important for property owners to pay attention to and correct any and all hazards with an understanding that they are responsible for the safety of others on their property.

3) Medical Malpractice

Medical malpractice cases can result when health care professionals fail to provide the appropriate level of care.  Examples include surgical errors, misdiagnosis, incorrect treatment, pharmacy mistakes, birth injuries, and much more.  These types of injuries can have severe and permanent effects on the victims who have to live with them for the rest of their lives.  Medical malpractice suits are often more complex and technical and usually involve larger settlements.  Having an experienced medical malpractice attorney at the Lake of the Ozarks can greatly improve the chance of prevailing and receiving a proper settlement for you.  When it comes to avoiding malpractice, here are a few things you can do:

-Research your medical provider

-Ask questions and take notes

-Keep good records of everything

-Bring someone with you to listen and witness

-Provide the most accurate medical history you can for your medical provider

5 Things to Consider If You Are Involved in a Car Accident

At Gibbons Law Firm, we hope you never have to experience being in a car accident. Even a small car accident can be rattling when you are the one in it, and big ones can be devastating.  It only takes a fraction of a second, one wrong judgment, or a quick distraction for an accident to happen.  Here in the Ozarks, with winding roads and blind curves and no shoulders on many of the roads, conditions can be unforgiving.

If you ever find yourself in a car accident at the Lake of the Ozarks, we just want you to have an idea of what to do.  We know it is hard to focus at the time of an accident so we thought we would share some things in this week’s blog to help you prepare proactively. If you or someone you know has been injured in a car accident, you should contact a personal injury attorney at the Lake of the Ozarks.  Feel free to call our Lake Ozark law office today at (573) 348-2211 for a free consultation.

1) Safety First

The first thing you want to do is make sure everyone is ok right after the accident, see if anyone needs help, and make sure all are safe.  That includes assessing the potential for causing another accident.  The sooner you can move the vehicle out of the road the better.  If you can drive it to the side of the road then do so.  If not, then call a tow truck right away.  While waiting for the tow truck, do not stay inside your vehicle if it is in the middle of a busy roadway.  Get out of your car and stand on the side of the road as far from traffic as possible in case there is another collision and be mindful of traffic.

2) Call 911

Of course, you will need to contact the police so they can come to the scene to evaluate and conduct an accident report.  It is also important to make sure anyone who is injured receives medical attention immediately.  If someone is hurt, calling the ambulance will get them the help they need as well as document their injuries.

3) Document

As soon as possible, you should start noting everything you can remember about the accident.  Take pictures of the scene, write down what happened or what you saw.  Notice any outside conditions that may have been factors such as weather, road hazards, other traffic, etc. Gather as much information as you can as soon as you can. You should also request a copy of the police report for your records.  It will likely take a few days for it to be completed, and it will be important to have for your insurance claim.

4) Insurance

Another step to take after a car accident is to call your insurance company.  Letting them know you have been in an accident will get the claims process started.  The insurance company will be able to direct you on what to do next.

5) Representation

You do not need to feel alone.  You may have a million questions about what you are going to do … how you will recover physically, financially, emotionally.  At this time, the most important thing for you to focus on is your healing and not the potential court battle that may be looming.  Our law office at the Lake of the Ozarks is well equipped to fight the cause for you and get you the compensation you need to cover your injuries and more.  Your first consultation is free. If you have been involved in a car accident and have questions, call us today to get answers. Gibbons Law Firm successfully represented many clients and is here to help you too.  For more tips and insight on legal issues at the Lake of the Ozarks, feel free to follow us on our social media channels listed below!

Helping Families Through Difficult Times with Our Family Law Services

Family Law covers a broad range of situations … from adoption to divorce, to child custody.  Some are happy events, some are devastating events, but most of them are emotionally charged.  For many people, family means everything.  So, in any legal conflict regarding family, the stakes feel very high.

At Gibbons Law Firm we assist clients with all types of family law cases with compassion and dedication because we know how important it is for families to receive the help they need in difficult times. Today’s blog shares with you the different types of legal situations families can go through and how a family law attorney at the Lake of the Ozarks can help.

Separation and Divorce

When a marriage has become “irretrievably broken” and one or both spouses have decided that divorce is the best course of action, a family law attorney can assist with the details.  From division of assets and liabilities, spousal support, child custody, child support and more, a knowledgeable attorney with the ability to listen and counsel clients, to diffuse conflict and litigate when necessary, can make all the difference in the successful outcome of a family law case.

This is a large part of what practicing family law is about, and it is especially complex if there are children. During a divorce, spouses are making decisions that will have a big effect on the kids. An experienced mediator that helps navigate mutually agreeable terms with the least negative impact on the children can make the process go more smoothly and successfully.

Adoption & Guardianship

There are a multitude of circumstances that can lead to the need for an adoption or guardianship, but one thing is always true.  The welfare of a child or family member is of utmost importance and must be protected.  With Gibbons Law Firm, you can enjoy peace of mind knowing you have an experienced family law attorney to handle every step of the process.

Annulments, Prenuptials, Post nuptials

Family law attorneys can also help with other relationship arrangements including annulments. An annulment is different than a divorce in that it declares that a legal marriage never existed.  Gibbons Law Firm can help you with building the case and evidence to establish an annulment.  For couples interested in pre- or post-nuptials, we can assist with that as well.

Paternity Cases

Establishing paternity is another area of family law that our clients sometimes require.  If you are in a position where you are trying to prove paternity, having a highly effective family law attorney on your side can make a difference.

Termination of Parental Rights

This is yet another extremely sensitive aspect of family law where what is best for the children is the ultimate focus.  Unfortunately, sometimes that does means termination of parental rights.  At Gibbons Law Firm, our ability to investigate and negotiate cases becomes a significant asset to our clients dealing with this difficult situation.

The legal aspects of family law at the Lake of the Ozarks can be highly complex and extremely sensitive and emotional because of the personal nature of the disputes. Gibbons Law Firm is committed to providing the legal advice and counseling that clients need in difficult times while making life-changing decisions.  If you are involved in a family dispute or need legal advice for your family, contact our firm and make an appointment today.  We are here for you, to answer your questions and see how we can help.

Remember, your initial consultation with Gibbons Law Firm is always free.

Buying a Home at the Lake of the Ozarks: When Choosing an Experienced Real Estate Attorney Really Matters

When buying a home at the Lake of the Ozarks, most people expect to hire a real estate agent, an inspector, and an appraiser.  But what about an experienced real estate attorney at the Lake of the Ozarks?  It is, after all, a legal transaction, and one of the biggest purchases you may make in your life.  At the closing table, there are many different parties and interests that come together.  Who is there for the sole purpose of looking out for what is best for YOU?  When you hire a real estate attorney to represent you through the process, it is their job to look out for your best interests alone.  They don’t get paid by making sure the transaction occurs.  They are not there on behalf of the lender.  They are there just for you.

It may not be as critical on a typical or simple real estate transaction to have an attorney to represent you.  But there are some circumstances when having a real estate attorney involved is more important. So, to help you decide for yourself, we thought we would talk about ways in which an attorney may be beneficial to have when buying real estate.  Keep reading to learn more!

Legal Questions.

In the course of the closing process, you may have some specific questions or legal issues that arise that your real estate agent just can’t fully answer.  A lawyer has the legal background and experience to answer unique legal questions with more depth and detail.  An attorney also has a better understanding of the things that could lead to a court battle and what it takes to prevail.  Just as your real estate agent is very skilled in negotiating things like pricing and inspection results, your attorney will bring a high level of negotiating skills when it comes to your legal rights and the specific language needed to ensure them.

Legal Contracts.

Lawyers don’t just understand the language of contracts, they are well versed in drafting them.  Most real estate agents will use template contracts, they don’t typically write custom contracts.  But sometimes simple modifications or customization of that contract can better represent what the buyer wants or needs.  A real estate attorney will recognize the need for such language changes and be able to provide the proper verbiage.

Complicated Sales.

Some real estate transactions are more complicated or less regulated, like when there is owner financing or an all-cash sale, or a for sale by owner.  In that case, the terms of the agreement are determined by the negotiating parties.  This is when it is most critical to have a real estate attorney to represent you.  Other examples of more complicated transactions may include:

-Buying a home in another state

-Buying a house with serious issues like foundation or structural damage

-Buying a home through a special sale such as a short sale, an estate sale, or an auction/purchase from a bank.

Sometimes the same applies when selling a property if:

-The home is part of a divorce settlement.

-The home is being sold on behalf of a deceased relative and you are in charge of the estate.

-You have financial circumstances that cause you to sell a property with liens on it.

These kinds of complicated issues are second nature to an experienced real estate attorney.  A lawyer has the background to fine tune your contracts and legal documents to make them optimal for YOUR needs and help with the negotiations to get all parties to come to agreement.

If you are preparing to close on a house at the Lake of the Ozarks, we would be happy to sit down with you and talk about your transaction, answer your questions, and help you make an informed decision on whether you would benefit from your own legal representation.  At Gibbons Law Firm, your initial consultation is free, so you have nothing to lose!  Call us today, and feel free to follow us on social media using the links below for more tips and information.

Remember, your initial consultation with Gibbons Law Firm is always free.

Looking out for your Kids - Estate Planning for Single Parents

With all you do for your child each day, it is not uncommon for a single parent to not really think about estate planning.  It is the last thing you want to think about and perhaps painful when you do. As a single parent, it never escapes your mind that your child depends on you for everything he or she needs.  You will always want the best for your child no matter what.  But parents don’t know where to start when it comes to estate planning and can become overwhelmed before they even get started.

At Gibbons Law Firm in Lake Ozark, we want you do know that it doesn’t have to be complicated.  We have helped many single parents through the process, and we are here for you too.  So, we thought we would share 3 things to consider in this blog that we hope will make it easier for you to get started.

Guardianship

Deciding who will raise your children if you were to die may be the most difficult part of estate planning for single parents.  It also is extremely important. If your child’s other parent is not able or willing to raise your child, who would make decisions for him or her regarding medical care, education, religion, extracurricular activities, where they live and everything else? Often, a close family member will be chosen, like a parent or sibling of the late parent. But it also may be a close friend or someone who you trust to love your child like their own. It is good to consider things like parenting styles and philosophies, and your vision for your child’s home environment, safety, and future.  If those are congruous with yours it may be easier on your child to adjust to a new home, especially when they are already feeling disruption and loss. Whoever you choose, it is important to speak with them before making your decision, so you know they are willing and able to take on the responsibility of raising your child.

Life Insurance

You bear the expenses of raising a child every day and you know better than anyone that it is not cheap.  A life insurance policy can make all the difference in your child’s future security and financial stability if you were to pass away before they are of age.  However, it is also important that any money there to provide for your child serves its purpose in going towards your child’s needs.  Gibbons Law Firm would be happy to talk with you about trusts and ways to dictate how and when the money will be available to your child. That way you can allow him or her to reach an age you feel they will be financially mature and self-responsible before having unrestricted access to the money.

Will

Having a will is probably the most important thing in your estate plan as it can designate everything else. Without a will, the state will determine everything from who your child lives with to what they inherit.  Our attorneys are experienced in estate planning at the Lake of the Ozarks and can help you keep the state from making these critical decisions instead of you.

We know it is an uncomfortable subject, but we also know it is an important conversation to have.  At Gibbons Law Firm, we strive to make the process easy for you and have done so for many of our clients.  Our estate planning attorneys in Lake Ozark are happy to answer your questions and guide you in the right direction to a solid estate plan. Don’t wait to schedule your consultation.  Your first one is FREE, and we look forward to helping you!  If you found this blog helpful, you can catch regular tips and information by following our social media links below.

Remember, your initial consultation with Gibbons Law Firm is always free.
